Terms & Conditions
These Terms and Conditions constitute a legally binding agreement made between the customer and Residential Gates Ltd, concerning your access to and use of www.residentialgates.co.uk as well as any other media form linked to Residential Gates Ltd website.
The customer agrees that by accessing Residential Gates Ltd website and choosing to purchase any goods from here, they have read, understood and agreed to be bound by all of these Terms and Conditions.
Residential Gates Ltd is a company registered in England and Wales; company registration number 12323507 VAT number 340 1826 32. The registered office address is 46-48 Mere Green Road, Sutton Coldfield, West Midlands, B75 5BT. Contact telephone number 0121 759 9988.
In these Terms and Conditions references to “we”, “us” and “our” shall be references to Residential Gates Ltd and “you” as the customer.
1.1 All prices shown on our website, social media and advertisements are in pound sterling and include VAT @ 20%.
1.2 Prices and discounts shown on our website, social media and advertisements are subject to alteration without notice. However, these changes will not affect orders that have already been dispatched.
2.1 Payment is required in full for products upon checkout online or by telephone, before the items will be dispatched.
2.2 We accept payment by Visa Credit, Master Card, Visa Debit Maestro, American Express. By providing us with credit or debit card details to complete your purchase you are confirming that the card is yours.
2.3 If you require customisation on your product and the payment has been made in full, this order cannot be cancelled. If any changes in design are required after confirmation these will be at an additional charge.
2.4 You will receive an order confirmation after your purchase, which will confirm design, colour and sizes.
3 Product Description
3.1 All goods and materials supplied shall conform to the quality described on our website and be fit for the purpose intended.
3.2 We cannot guarantee that the colours of products shown on our website exactly represent the appearance and colour of the products themselves, as images on the website can vary according to the resolution of your computer. However, if you provide us with a RAL code, we can guarantee the exact colour match.
3.3 Specifications of weight, dimensions and capacities given are approximately only.
3.4 It is the customer’s responsibility to ensure that the specification of the gate to be supplied is the correct measurement.
3.5 The customer is obliged to carefully examine all of the goods and materials supplied and will notify Residential Gates Ltd of any damages, faults or shortages within 72 hours. Failure to do so may result in extra charges if necessary.
4 Consumer Rights
4.1 If you are contracting as a consumer, you may cancel a contract at any time within 14 calendar days, beginning on the day after you received the products. In this case, you will receive a full refund of the price you paid for the products in accordance with our refunds policy (please see clause 6)
4.2 To cancel a contract, you must inform us in writing. You must also return the product(s) to us immediately within 14 calendar days of cancelling the contract, in the same condition in which you received them, and at your own cost and risk. You have a legal obligation to take reasonable care of the products while they are in your possession. Failure to do so, may give us the right of action against you for compensation.
5.1 Residential Gates Ltd will do our best to meet any delivery date given or agreed, such dates are estimates and only given in good faith, we will not be liable in the event of the delivery period being exceeded or accelerated for any reason. However, we ensure to keep the customer informed and updated of any changes to delivery times by email or telephone.
5.2 The customers delivery address will be provided in writing at the time of purchase.
5.3 Residential Gates Ltd offers free delivery within mainland UK. If the customer is unable to accept delivery on this date, additional delivery charges will be incurred.
5.4 Ownership of the products will pass to you, when products have been delivered and paid in full. The products are then at your risk from time of delivery.
6 Refunds And Returns
This is to be read in conjunction with our Returns Policy.
6.1 Any products that have been customised i.e. Sizing, colours, designs cannot be refunded or returned once an order has been confirmed, started or delivered.
6.2 Standard products may be returned or refunded with Residential Gates Ltd consent and agreement. All returns are to the discretion of Residential Gates Ltd, products must return in the condition you received them in and we must be notified within 14 days.
6.3 Any returned orders within the 14 days will incur a restocking fee of 20% from original order, plus a collection charge of £100.00 Driveway Gates & £50.00 Garden Gates.
7 How To Cancel
7.1 If you wish to cancel an order please contact Residential Gates Ltd by calling 0121 759 9988 or emailing us at firstname.lastname@example.org. Please have your Order Acknowledgement email to hand and be ready to quote your order number and to specify which goods you want to return. Alternatively, you may give us written notice of your cancellation. This can be done by writing to us at 46-48 Mere Green Road, Sutton Coldfield, West Midlands, B75 5BT. You must include your order number in the written notice, and clearly specify which goods you wish to return.
7.2 Where you cancel your order after the goods have been delivered you agree to return the goods to us by following the procedure set out below.
8 Returning Your Goods
8.1 If you would like to return the goods yourself, you can return them to the showroom/warehouse address Unit 1, Shenstone Storage Estate, Staffordshire, WS14
0EA. You will need to take all of the goods you are returning, together with a copy of your Order Acknowledgment email, delivery receipt and the payment card with which you paid for the goods.
8.2 To arrange collection of the unwanted goods please contact Residential Gates Ltd on 0121 759 9988 or emailing us at email@example.com. Please have your order number and delivery receipt to hand. We will then arrange for your unwanted goods to be collected by a Residential Gates Ltd representative. A collection fee may apply.
8.3 You agree to return the goods in full, in a resalable condition and securely packaged (properly repacked in their original packaging if they were removed from it). You are responsible for all costs of returning the goods. Please Note: We are unable to accept returns of cementitious or other perishable products.
9 Taking Reasonable Care Of The Goods
9.1 You agree to take reasonable care of the goods from the time that they are delivered to you until the time that they are returned. Examples of a failure to take reasonable care of goods may include if you use the goods, or if you remove the goods from their packaging and fail to properly repack them or if you do not protect the goods from inclement weather. If your failure to take reasonable care of the goods means that they cannot be resold as new, we reserve the right to apply a charge of between 30% and 100% of the price you paid for the goods, which you agree we may discount from your refund for the goods. We can only re-sell opened or used goods at a significantly discounted price and the charge is your agreed contribution to our likely loss on these goods.
9.2 If the goods are damaged whilst in your care, if you fail to return all parts of the goods or otherwise if your failure to take reasonable care of the goods means that we reasonably believe that resale will not be possible at all, you agree that we may withhold payment of all or part of the refund in respect of the goods as compensation for our loss on these goods. Without limitation.
10 Conditions Of Collection
10.1 Collection of the goods will only take place from the delivery address to which they were delivered, and will be subject to the following conditions:
10.2 You agree to provide Residential Gates Ltd with as much detail as possible of relevant features of the delivery address in order to help our representative prepare for the collection (including any specifically any site restrictions).
10.3 You agree to ensure that there is suitable access to the chosen collection location; if collection cannot be made from your chosen location due to the nature of the premises, because there is insufficient access or for any other reason that is not within our reasonable control, including your absence at the time of collection, you agree to pay our reasonable additional collection fees and the costs of re-arranging collection.
10.4 If our representative reasonably considers that collection is likely to cause damage to the goods or to your property, they will inform you and record this concern on the collection document. You may instruct our representative to collect the goods in spite of such concern, but we will not be liable for any damage caused to your property or to the goods as a consequence of us attempting collection on your instructions (provided that reasonable care is taken in collecting the goods).
10.5 You agree to give our representative all goods which are being returned, including all component parts of such goods and all related items or accessories (including original packaging) which are included in the price of the goods being returned.
10.6 A collection document must be signed by you to confirm that the collection has taken place. The collection document will be provided by the representative who comes to collect your goods.
10.7 You keep the goods at your own risk until they have been removed by our collection agents from your premises.
10.8 If you are not personally available to undertake any of your obligations under this paragraph 7.1, you may appoint a representative to do so in your place. The representative must be an adult capable of supervising collection on your behalf, and you agree that we will be entitled to rely on the representatives instructions as if they were your own.
10.9 This paragraph 7.1 does not take away any rights you may have under law. To find out more information contact your local Citizens Advice Bureau (www.citizensadvice.org.uk).
11 Collection fee
11.1 Collection fees will apply to each collection made by us and will be charged in full even if not all the items you ordered are being returned.
11.2 If you are returning your goods because they are faulty or incorrect, no collection fee will be charged.
12 Refunding your money.
12.1 We will make all refunds to the card used for payment.
12.2 The refund will include the cost of the returned goods and the original delivery fee (where you are returning all of the goods on the order) less any charges for failure to take reasonable care of the goods and any collection fees.
